CONTRACTOR’S AND SUBCONTRACTOR’S REPRESENTATIVE
- The CONTRACTOR’s Representative shall represent the CONTRACTOR and supervise the Subcontract Works at the Subcontract Works Site. The CONTRACTOR may, from time to time, appoint a deputy (or deputies) to the CONTRACTOR’s Representative.
- The SUBCONTRACTOR shall notify the CONTRACTOR of the appointment of the SUBCONTRACTOR’s Representative within five (5) Days from the Effective Date in order to receive approval for such appointment from the CONTRACTOR. Following the CONTRACTOR’s approval, the SUBCONTRACTOR’s Representative shall be entitled to represent the SUBCONTRACTOR. The SUBCONTRACTOR shall not change the SUBCONTRACTOR’s Representative without the CONTRACTOR’s prior written consent.
- The SUBCONTRACTOR’s Representative shall have full power and authority to represent the SUBCONTRACTOR in all matters relating to the Subcontract Works. All instructions given to the SUBCONTRACTOR’s Representative shall be deemed given to the SUBCONTRACTOR. The SUBCONTRACTOR may, from time to time, appoint a deputy to the SUBCONTRACTOR’s Representative, in writing, and state the extent of the authority vested in him. Approval of the deputy must be given in writing by the CONTRACTOR.
- The SUBCONTRACTOR’s Representative shall not be engaged in any work other than that for the Subcontract Works. If the CONTRACTOR is of the opinion that the SUBCONTRACTOR’s Representative is incompetent, or has committed a breach of his duties under this Subcontract, or has been objected in writing by the COMPANY, the SUBCONTRACTOR shall remove and replace the SUBCONTRACTOR’s Representative at the SUBCONTRACTOR’s sole cost and expense immediately upon receipt of notice from the CONTRACTOR.
